Carelendr Terms of Service

1. Who can use Carelendr

You must be 18 or older to use Carelendr. Carelendr is a professional tool for adults who work as caregivers, including Direct Support Professionals, home health aides, and similar roles. If you are not a caregiver or care provider, this app is not for you.

By creating an account, you confirm that you are at least 18 years old and that the information you provide is accurate.

2. What Carelendr does

Carelendr helps you create, organize, and export professional visit documentation. The public /caregiver workspace also lets you build an in-memory earnings and commute plan and open the official NJ DDD Provider Search. Carelendr does not currently match caregivers with providers or jobs, submit applications, or send the public workspace to providers. The app uses on-device AI to help you structure your notes. Your notes are stored on your phone. When you choose to export or share a note, you control where it goes.

Carelendr does not submit documentation to any agency or billing system on your behalf unless you explicitly use a feature that does so, and that feature will clearly tell you what it is doing before it acts.

3. Your account

You are responsible for keeping your login credentials private. Do not share your account with anyone else. If you think someone else has accessed your account, contact us at admin@fynetwork.com immediately. Your account is personal to you and may not be transferred to another person.

4. Your documentation

The notes and documentation you create in Carelendr belong to you. You own them. FY Network does not claim ownership of your work product.

When you use the app's AI features to structure or polish a note, the AI processes your input to produce a structured output derived from what you entered. You are responsible for reviewing the output and attesting that it is accurate before you use it professionally.

FY Network is not a HIPAA covered entity and does not act as your employer's business associate unless a separate written agreement is in place. If your employer requires specific documentation systems or formats, you are responsible for ensuring your use of Carelendr complies with those requirements.

5. What you may not do

You may not use Carelendr to:

• Create false or misleading documentation
• Document care that did not occur
• Submit fraudulent claims to Medicaid, Medicare, or any other payer
• Access another person's account without their permission
• Use the app in a way that violates any applicable law or regulation

Fraudulent documentation is a serious matter. If we become aware that an account is being used to create false records, we will close the account and may report the activity to the appropriate authorities.

6. Service availability

Carelendr is provided as-is. We work hard to keep the app reliable, but we cannot guarantee that it will be available 100% of the time or that it will be free of errors. We are not liable for any loss or damage caused by downtime or errors in the app. The app is in active development and features may change; we will try to give advance notice of significant changes.

7. On-device AI

The AI features in Carelendr run on your device. Your note text is processed locally. We do not send your raw note text to a cloud server for AI processing unless a feature explicitly tells you it is doing so.

When we do send data to external AI services, we use providers that meet our privacy and security standards. No data that could identify your clients is included in AI requests. AI outputs are drafts, and you are responsible for reviewing them.

8. SMS and text messaging program

If you provide your mobile number and consent during signup, you agree to receive one-time passcodes and account or credential notifications that are enabled for your account. Carelendr does not currently send provider or job matches, application submissions, or matched shift confirmations by text. Carelendr does not send marketing or promotional text messages.

Message frequency varies. Message and data rates may apply. Reply STOP to any message to opt out, and reply HELP for help. You can also contact admin@fynetwork.com. Consent to receive text messages is not a condition of using any paid service.

Mobile carriers are not liable for delayed or undelivered messages. How we handle text-message data, including that opt-in data is not shared with third parties, is described in our Privacy Policy at carelendr.com/privacy.

9. Privacy

How we handle your personal information is explained in our Privacy Policy at carelendr.com/privacy. These Terms do not modify or replace the Privacy Policy. Both documents apply to your use of Carelendr.

10. Intellectual property

The Carelendr name, logo, app design, and underlying technology belong to FY Network, Inc. You may not copy, reverse-engineer, or redistribute any part of the app without our written permission.

11. Changes to these terms

We may update these terms from time to time. If we make a significant change, we will notify you in the app or by email before the change takes effect. Your continued use of Carelendr after the effective date of the updated terms constitutes your acceptance.

12. Ending your account

You may delete your account at any time from the app's Settings screen. After deletion completes, Carelendr removes your caregiver-owned application records from the primary database, your authentication account and credential objects, and Carelendr data stored locally on that device. Limited security and compliance audit records may be retained for the applicable legal and security retention period. Account deletion does not delete employment or operational records that a provider independently created or controls; those records remain subject to the provider's policies and applicable law. We may close an account that violates these terms, with or without notice.

13. Disclaimers and limits on liability

Carelendr is a documentation and coordination tool. It does not provide medical advice, clinical guidance, legal advice, or compliance certification. Do not use Carelendr as a substitute for professional judgment.

To the maximum extent permitted by law, FY Network's liability to you for any claim arising from your use of Carelendr is limited to the amount you paid for the app or service in the 12 months before the claim arose. If you have not paid anything, our liability is zero.

14. Governing law

These terms are governed by the laws of the State of New Jersey, without regard to its conflict of law rules. Disputes will be resolved in the state or federal courts located in New Jersey, and you consent to their jurisdiction.
